Andrew McCarthy, NRO: “Obama’s Amnesty Hits a Legal Roadblock“If a Texas judge’s temporary stay against it is upheld, it could be headed to the Supreme Court.

“To be clear, the order issued by Judge Andrew Hanen of the U.S. court for the southern district of Texas in Brownsville is a temporary stay. It is not a ruling on the merits of the lawsuit brought by 26 states that claim they will suffer profound financial and other damage from the president’s lawless executive action — an action that Obama himself many times conceded would be lawless before he finally took it late last year.

“Today, the Justice Department will seek an emergency order from the Fifth Circuit U.S. Court of Appeals to block Judge Hanen’s injunction. There is a good chance the Justice Department will succeed, at least temporarily. If the Fifth Circuit blocks the injunction, that, too, would not be a ruling on the merits of the case. It would just mean a return to the status quo that allows Obama to proceed with the implementation of his amnesty decree.

I imagine we will know by late this afternoon whether the Fifth Circuit will set aside the district court’s injunction.

“Judge Hanen’s order would temporarily prevent the Obama administration from implementing the executive action — in particular, the issuance of positive legal benefits, like work permits, for illegal aliens despite the lack of statutory authorization. The stay would also allow Judge Hanen a chance to issue a final ruling on the merits of the case. Again, he has not at this point conclusively ruled that Obama’s executive amnesty violates the Constitution or other federal law.

“To justify issuing the stay, however, he had to decide that the states that brought the lawsuit had demonstrated a likelihood of success on the merits. . .”

“President Obama claims he inherited a mess in the Middle East. Not so. “Fracking and horizontal drilling on private lands in the U.S. had taken off in the last years of the Bush administration and by 2009 were set to revolutionize America’s energy future. By 2011, the U.S. had cut way back its dependence on Middle Eastern gas and oil imports, which in turn gave American diplomats a measure of immunity from petro-blackmail, and therefore far more clout in the region. Iraq was mostly stable; in Anbar Province tens of thousands of jihadists had been killed by U.S. troops and their tribal allies. Iran’s scope was limited by a new moderate axis of Sunni states, Israel, and the United States. A bruised Hezbollah faced a huge rebuilding tab in southern Lebanon. “Charles Krauthammer said Monday on ‘Special Report with Bret Baier’ that the extremist video showing the beheading of several Egyptian Coptic Christians ‘is a kin to Nazism.’

“What will it take before the President and his supporters start taking antisemitism seriously?

“It’s hard not to notice certain parallels between Saturday’s events in Copenhagen and events in Paris last January 7 and January 9.

“In the latter case, first people were attacked (at the Charlie Hebdo offices) for having insulted Islam, and then “folks” (in President Obama’s memorable formulation) were attacked for being, well, folks. In the Copenhagen case, similarly, first Islam-insulters were attacked, and then…folks.

“In both cases the ‘folks’ were Jews—what a coincidence.

“Of course, sarcasm aside, it wasn’t really a coincidence at all. For thousands of jihadists in the world and many millions of Muslims—certainly not all, but significant numbers—who support them, having been born a Jew is sufficient grounds to be killed. In an earlier iteration, this was known as Nazism.

“Yet, while there is clearly an Islamic tradition of antisemitism rooted in the Koran, Jews and Jew-killing have generally not been an obsession in the Islamic world. What makes our era different, of course, is the existence of that intolerable outrage known as the state of Israel, which occupies one-sixth of 1 percent as much land as the Muslim Arab countries, and of course, an even tinier proportion of the total land mass of the Muslim countries.

“If Israel didn’t exist and there were only some Jewish minorities in today’s world, jihadists and their supporters would not be obsessed with them and attacking them. Because of Israel’s existence, jihadists now view all Jews, wherever they live, as members of the same accursed, demonic tribe that has no right to life. Hence the current situation in Europe, where synagogues and Jewish schools require the presence of armed soldiers and police officers.

“It would be one thing if the assault was basically being mounted by part of the Muslim world while the rest of the world was standing behind Israel and the Jews. Unfortunately, that is hardly the case. The sad reality is that, seven decades after the Holocaust, the Jewish state is the most vilified country in the world, and the Western countries play a large role in the vilification.

“A poll this year, for instance, finds that Britons view only North Korea as worse than Israel, while viewing Iran, Pakistan, and Saudi Arabia more favorably than Israel. Also this year, a poll finds 35 percent of Germans equating Israeli policies with those of the Nazis and 48 percent having a ‘poor’ opinion of Israel. More generally, a BBC poll of world opinion in 2013 found only North Korea, Pakistan, and Iran to be less popular than Israel.

“There was the February 9, 2014, Times article headlined “The End of Snow,” which ran on the front page of the paper’s Sunday Review section, and which the ever-shrewd Matt Drudge remembered, and linked from his Drudge Report site, amid the snowmaggeddon roughly a year later. “In the Northeast, more than half of the 103 ski resorts may no longer be viable in 30 years because of warmer winters,” the article warned. “It’s easy to blame the big oil companies and the billions of dollars they spend on influencing the media and popular opinion. But the real reason is a lack of knowledge. I know, because I, too, was ignorant until I began researching the issue for a book on the future of snow…. This is no longer a scientific debate. “Geller’s event comes on the wake of the Islamic terrorist attack on the French magazine Charlie Hebdo in January. Following the attack, the Council on American-Islamic Relations (CAIR) scheduled the “Stand with the Prophet” conference at the public school district’s conference center. Geller, the President of the American Freedom Defense Initiative (AFDI), scheduled a protest outside the event that was attended by approximately 2,000 people.

“During the Free Speech Rally in Garland, Geller spoke with Breitbart Texas about her reaction to the large and loud crowd of protesters. She said that Muslims are trying to impose restrictions on free speech like they are doing in Paris. ‘Thousands of Americans said ‘no way!’’

“‘The media can smear us and the President can stand with them,’ Geller said. ‘We the people are not having it. If there is any proof of that, it’s today. We dwarfed them.’

‘If the Western media ran the Danish cartoons back when this Islamic supremacist movement first started gaining steam, the editorial staff of Charlie Hebdo would be alive today,’ Geller stated in response to an inquiry from Breitbart Texas. ‘That said, the European press ran the Hebdo cartoons in the wake of that jihad slaughter. But the American press would not. The beacon of freedom, the shining light on a hill, is running scared. Well, that’s not who we are. The elites do not represent the people.’

“‘Enough is enough,’ she explained. ‘They’re just cartoons. We’re holding this exhibit and cartoon contest to show how insane the world has become — with people in the free world tiptoeing in terror around supremacist thugs who actually commit murder over cartoons. If we can’t stand up for the freedom of speech, we will lose it — and with it, free society.’

“The art exhibit and contest will be held at the Curtis Culwell Center in Garland on May 3rd.  This was the site of a Muslim conference denouncing ‘Islamophobia’ — an obscene stand for them to take after the Charlie Hebdo massacre – and our massive Free Speech Rally outside that event,’ Geller wrote in a press release obtained by Breitbart Texas.

“The contest will take submissions online and the winner will be announced at the event in Garland. The winning cartoonist will receive a $10,000 prize. The exhibit will feature images of Islam’s prophet in both historical and contemporary settings. There will also be a series of speeches by internationally renowned free-speech advocates.

“Geller explained that the art exhibit is the next logical step following AFDI’s Free Speech Rally in Garland. ‘This event will stand for free speech and show that Americans will not be cowed by violent Islamic intimidation,’ she stated. ‘That is a crucial stand to take as Islamic assaults on the freedom of speech, our most fundamental freedom, are growing more insistent.’

“‘Of course, this event will require massive security,’ she assured potential attendees. ‘But this exhibit has to be staged. If we don’t show the jihadis that they will not frighten us into silence, the jihad against freedom will only grow more virulent.’

“An author and activist with passionate fans and detractors, Geller has been sounding the alarm about Muslim encroachment into Europe and America and the possible impact on American culture in the future. The Free Speech Rally Geller organized is one of many activities she has created to shine the light on radical Islam and the teachings of Imam’s in mosques in the United States.  In June, 2010, Geller organized and led a group of approximately 5,000 protesters (Geller released this estimate) to march on the site of the site of the proposed ‘Ground Zero Mosque.’

“Eventually, plans for the mosque were cancelled.

“Geller is also listed as an ‘Extremist’ on the left-wing Southern Poverty Law Center’s (SPLC) website. The SPLC says she is the ‘anti-Muslim movement’s most visible and flamboyant figurehead. She’s relentlessly shrill and coarse in her broad-based denunciations of Islam.’ The organization also lists AFDI as an anti-Muslim hate group.”
