Janet: Obama Care:

There are no more excuses for not repealing Obamacare. Establishment Republicans are, nonetheless, dragging their feet on what was a major campaign promise. We are hearing that liberals are calling Congress in massive numbers to ensure the survival of socialist medicine and the ‘death panel’. Conservatives must act asap.

The deadline to repeal Obamacare, with the reconciliation process that allows passage in the Senate with only 51 votes (Republicans have 52), is April 28, 2017.

Please be aware that repeal must come first, then, replace. A transition period is included in the repeal effort that gives Obamacare insurers and insured the time to transition to a replacement plan. Combining repeal and replace significantly jeopardizes the repeal process.

“As the Berkeley Police Department gears up for yet another showdown between First Amendment supporters and violent “anti-fascists,” questions have arisen regarding the mayor’s ties to a local anti-fascist group. Ann Coulter vowed to move ahead with a planned speaking engagement at the university on Thursday after her speech was canceled due to security concerns.

Law enforcement sources told Fox News there is a “99 percent” chance that the college will erupt in violence over the appearance — whether she shows up or not.

‘Charles ‘Sid’ Heal, a retired commander from the Los Angeles Sheriff’s Department who met with Berkeley police on Monday, said that authorities are preparing for the worst because extremist groups from across the spectrum are heading to Berkeley, and because the past three protests that devolved into violence were met by a ‘lackluster’ response from local police.

‘We’ve been told they’re going to come no matter whether Ann Coulter comes or not, and the next riot is not a standalone in isolation but a natural consequence of the lackluster approach of the past,’ Heal said, adding that because protesters felt police didn’t protect them at the last riot many are pledging to defend themselves. ‘People are becoming vigilantes.’

“According to Fox News, Heal and others are saying ‘there is deep discord between the Berkeley Police Department and the city government.’ Mayor Jesse Arreguin, 32, has been accused of being in cahoots with the protesters because, as this reporter noted at PJ Media’s Hot Mic on Friday, he was a member of the Facebook group “By Any Means Necessary,” or BAMN, the violent anarchist group that has instigated riots in Berkeley and across the country.”

“A federal judge in San Francisco issued a temporary injunction today against the Trump administration’s vow to strip all federal funding from jurisdictions deemed to not be fully complying with immigration officials, ruling the federal government is limited to a few law enforcement grants that already carried the condition of cooperation.

“Santa Clara County, Calif., later joined by the city and county of San Francisco, sued over President Trump’s Jan. 25 executive order ‘Enhancing Public Safety in the Interior of the United States,’ which stated the attorney general and Homeland Security secretary, ‘in their discretion and to the extent consistent with law, shall ensure that jurisdictions that willfully refuse to comply with 8 U.S.C. 1373 (sanctuary jurisdictions) are not eligible to receive Federal grants.’

“The California counties argued that directive ‘violates the separation of powers doctrine enshrined in the Constitution because it improperly seeks to wield congressional spending powers,’ was ‘so overbroad and coercive that even if the president had spending powers, the order would clearly exceed them and violate the Tenth Amendment’s prohibition against commandeering local jurisdictions,’ and was ‘so vague and standardless that it violates the Fifth Amendment’s Due Process Clause.’. . .”

“Some lawmakers are optimistic they can hammer out a budget bill to take the government to the end of the current fiscal year on Sept. 30, while others see Congress putting a short-term spending resolution in place for a week, while talks continue.

“Either way, the pressure is mounting to come up with a plan before Friday night. If lawmakers do not have one, funding for many federal agencies will abruptly stop and millions of government workers will be temporarily laid off.

“Many policy makers are nervous about a repeat of 2013, when the government was shuttered for 17 days.

“On Monday President Donald Trump eased up on demands to include funding for a southern border wall in any budget pact, clearing a major obstacle in the negotiations. . .”

“Once upon a time, most Republicans believed in tax cuts. Somewhere along the way, inside the beltway especially, Republicans forgot about the benefits of cutting taxes. Republicans became more concerned with government keeping “its” revenue than letting the people keep their money.

“Too many Republican have become timid about tax cuts, often spouting the milquetoast line of “revenue neutral tax cuts.”

“Let me translate that little bit of Washington-speak for you. ‘Revenue neutral’ tax cuts aren’t really tax cuts. It’s more like tax shifting. Some will pay more. Some will pay less. And the net effect will be that government will collect the same amount of taxes.

“If revenue neutral tax shifting is what Republicans stand for, maybe it’s time we re-evaluated what we really stand for.

Billy House et al., Bloomberg: “Trump’s Wall Demands May Decide Whether 100th Day Is a Shutdown”

“Nobody in Washington is saying they want a U.S. government shutdown when funding runs out at week’s end, but one person ultimately may get to decide: President Donald Trump.

“Trump’s biggest demand is a Democratic deal-breaker: money for his long-promised border wall with Mexico. Democrats hope he’ll blink to avoid an embarrassing milestone for a new president trying to prove he can govern. A partial shutdown would start on Saturday, Trump’s 100th day in office.

“The Wall is a very important tool in stopping drugs from pouring into our country and poisoning our youth (and many others)!” Trump wrote Monday on Twitter.

“There is an out for both sides — a short-term spending plan that would provide another week or so for negotiations after the deadline early Saturday.

“But right now, each side is dug in. And Trump is making things more complicated, not less. At the same time as budget talks intensify, he’s pushing House Republicans to re-start work on an Obamacare repeal-and-replace bill after the last one imploded in March when conservatives walked away.

“Trump’s also planning to announce at least the broad parameters of a tax overhaul on Wednesday that seems sure to have plenty to annoy Democrats, including likely tax cuts for corporations and high-earners. . .”

Washington Examiner: “What today’s fascists don’t understand”

“Howard Dean thinks “hate speech” is not protected by the First Amendment. A New York University professor was given space in the New York Times to deride the idea of “a blanket permission to say anything anybody thinks” and to defend protestors who, using violence, shut down a speech that was to be delivered recently by Charles Murray, the social scientist. A political science professor at Middlebury, the college where Murray was barracked, jostled, and threatened, apologized to the perpetrators for inviting Murray.

“Justification of modern, left-wing fascism and spineless capitulation in the face of it is becoming more common. The illiberal tide is rising. This isn’t just a thing among wacky rich kids at colleges aren’t worth the fees they charge. No, a growing minority on the left argues against the principle of free speech and against the idea of open debate. They use bad law and bad philosophy for their arguments.

“They would, without a doubt, gravely regret the consequences if they got their way, for the results would be pernicious.

“Ann Coulter, the right-wing provocateur, was invited to speak at the University of California, Berkeley, recently, which infuriated campus militants. Some of them protested and threatened massive disruption, at which the university caved in and canceled Coulter’s speech. The censors — they are thought police, the same ilk as book burners — had won. They deployed the threat of violence to silence a voice that disagreed with them.

“Former Vermont Governor and Democratic National Committee Chairman Howard Dean thought this was just fine. Citing a tasteless Ann Coulter joke about Timothy McVeigh blowing up the New York Times building, Dean wrote on Twitter “Hate speech is not protected by the first amendment.”

“Dean is an ass. He is flatly wrong, as every scholar of the First Amendment could show. Hate speech, crazy speech, idiotic speech, communist speech, fascist speech, racist speech, sexist speech — they’re all protected by the Constitution. Incitement to violence, speech actually urging people to attack others, is a rare exception to the freedom of speech. But joking that you wished someone were dead doesn’t count as incitement. . .”

“On Tuesday’s Mark Levin show, Were there any federal district judges out there who weren’t appointed by Barack Obama? It appears all of these immigration cases wind up in front of left-wing kook judges. Now another Obama judge is blocking President Trump’s cutoff of funds to sanctuary cities. It’s remarkable that we have federal judges who are appointed by the most radical leftist president in American history, who take his political philosophy, reverse what is basically 100 years of jurisprudence, that they have fought for, and then impose their will. You can’t have a centralized administrative state by allowing Congress to do its job. San Francisco is free to be a sanctuary city, even though it defies federal law. However, now the federal government is not free to withhold federal funds from a city defying federal law.

“After that, the one area where Trump has succeeded, is in unravelling the executive orders of Obama. He is using same power Obama did to undo what Obama did. However, the President is having a tough time with the Republican Congress. There is no excuse for what Mitch McConnell and Paul Ryan are doing or not doing. It is time to roll Chuck Schumer and the Democrats. The “Art of the Deal” should be the “Art of Victory”.

“Why aren’t the first 100 days a measuring stick for Congress and the Democrats? Can anyone name one piece of positive bipartisan legislation that Nancy Pelosi and Schumer have put forth? In addition, the Republicans have the Presidency, House and the Senate and it is their fault the government shuts down? This is not true, but it was the same during the Obama years. No matter what they always get blamed. The Republicans need to take their case to the American people. Many of these elected Republicans don’t want to make waves, because they want to hold onto power.

“Finally, how about we drive down the cost of the lumber industry and make it more competitive rather than passing tariffs on Canadian lumber? Whenever you hear a tariff is enacted, that is a sales or vat tax on the American consumer. Let’s not pretend that protectionism and tariffs don’t put the American people out of work. What the Trump administration should do is open our federal lands to logging and have us compete with Canada that way.”
